Founded on the belief that empathy can be trained.

Enliven Social Enterprise B.V. | Arnhem, Netherlands

Enliven was founded in 2014 in Arnhem, the Netherlands, with a single conviction: empathy is not a trait people either have or lack. It is a skill that can be developed through experience. What began as a mission to address social challenges through immersive technology has grown into a platform trusted by enterprise organizations worldwide.

Our founding team brought together expertise in XR development, behavioral science, and facilitation design. The first VR experience, Vergeet Mij Niet, won the JenV Innovation Award from the Dutch Ministry of Justice and Security and was adopted by more than 60 organizations across the Netherlands, proving that immersive experiences could shift behavior at scale.

From that social sector foundation, Enliven entered the corporate market in late 2024. Within 18 months, the methodology was validated at ASML, McKinsey, Reckitt, Microsoft, Cambridge University Press, and Shimano. Today, Enliven operates as a social enterprise, reinvesting in impact while delivering measurable behavior change for the world's most demanding organizations.

Enliven Social Enterprise B.V., a Dutch company, having its registered office at Jansbuitensingel 30, 6811AE Arnhem, the Netherlands, and all its affiliated companies (Enliven, we, us, or our) makes its online virtual reality software as a service solution available through its platform (the Platform) to companies (the Company), the employees of the Company, or other persons authorized by the Company to access and use the Platform on behalf of the Company.

Enliven takes the careful handling of your personal data very seriously. As the party responsible for processing your personal data, we ensure that your personal data is handled and protected with the utmost care. In doing so, we always comply with the applicable laws and regulations. While we are active in the European Economic Area (EEA) and keep our data on servers within the EEA, we are exploring expanding our operations to other parts of the world.

2. Legal Grounds

We process your personal data based on the following legal grounds defined in European privacy legislation: (1) consent, (2) execution of an agreement with you, (3) legal obligation, and (4) legitimate interest of Enliven or a third party.

Account Data: First name, last name, email address, phone number, organization name. Grounds 2 or 4 apply.

IP Address: Detected upon each visit for technical and functional management. Ground 4 applies.

Marketing: We may use your contact information for marketing communications such as newsletters. You may unsubscribe at any time. Grounds 1 or 4 apply.

3. Retention Period

Account Data: Retained for as long as you actively use our Services. After account deletion or inactivity, retained for an additional 2 years.

Financial Records: Retained for 7 years in accordance with tax laws.

Other Personal Data: Retained for 2 years after our last meaningful interaction.

4. Sharing with Third Parties

We may use third parties for hosting, data analysis, payment processing, customer service, email delivery, and marketing. These parties process data on our behalf only to the extent necessary for service provision. We may also share data with competent authorities when required by law.

5. Transfer Abroad

Your personal data will not be transferred outside the European Economic Area. Should this change, we will notify you in advance and seek explicit consent if required by law.

6. Your Rights

These General Terms and Conditions (the GTC) govern the use of Enliven's Platform and the provision of Enliven's Services, and form an integral part of every Agreement between the Customer and Enliven.

Article 1: Definitions

Agreement: The contract between the Customer and Enliven pursuant to which Enliven provides Services and/or grants access to the Platform.

Customer: The company or legal entity that enters into the Agreement with Enliven.

Platform: Enliven's online VR software-as-a-service platform providing Users with access to VR Simulations and related content.

Services: Platform Services and/or Delivery Services, as applicable.

Session: A single facilitated immersive training event delivered using the SIF, typically 2 to 3 hours, maximum 16 participants.

SIF (Standardized Immersion Format): Enliven's proprietary three-component session format comprising (i) a VR experience, (ii) facilitated group dialogue and structured reflection, and (iii) behavioral activation and commitment.

VR Equipment: Virtual reality headsets, controllers, and associated hardware provided by Enliven on a temporary loan basis. Title remains with Enliven at all times.

Article 2: Applicability

These GTC apply to all Agreements between Enliven and the Customer. Any general terms of the Customer are expressly rejected. In case of inconsistency between GTC and a Statement of Work, the SOW prevails for commercial terms; GTC prevail for legal terms. Enliven may amend these GTC with 60 days' notice.

Article 3: Agreement Formation

An Agreement is established when the Customer accepts a quote in writing or when both Parties execute a SOW. Quotes are valid for 30 days. Oral commitments are not binding unless confirmed in writing.

Article 4: Service Tracks

Enliven provides two service tracks: Platform Services (subscription-based access) and Delivery Services (session-based facilitation). These may be engaged independently or in combination.

Article 5: Platform Services

Enliven grants a limited, non-exclusive, non-transferable right to access the Platform for internal business purposes. The Customer may not reverse-engineer, sublicense, or make the Platform available to third parties. Platform Services auto-renew unless terminated with 60 days' notice.

Article 6: Delivery Services and the SIF

Sessions are delivered in accordance with the SIF on a best-efforts basis. Enliven may engage sub-contractors and methodology partners without requiring prior consent. VR Equipment is loaned for session duration only; title remains with Enliven.

Article 7: Intellectual Property

All Intellectual Property Rights in the Platform, VR Simulations, SIF, and related materials vest exclusively in Enliven. No rights are transferred to the Customer unless expressly stated. Session data ownership is shared: aggregate anonymized data may be used by Enliven for benchmarking.

Article 8: Fees and Payment

Fees are as specified in the Agreement. Invoices are due within 30 days. Late payment incurs statutory commercial interest. Cancellations within 10 Business Days of a confirmed Session incur a cancellation fee of 50% of the Session fee; within 5 Business Days, 100%.

Article 9: Liability

Enliven's total liability is limited to the fees paid under the Agreement in the 12 months preceding the claim. Enliven is not liable for indirect, consequential, or incidental damages. Force majeure relieves Enliven of performance obligations for the duration of the event.

Article 10: Governing Law

The Agreement is governed by the laws of the Netherlands. Disputes are submitted exclusively to the competent court in Arnhem, the Netherlands.
